1. Acceptance of Terms

By accessing or using LumenPostAI, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you may not access the Service.

2. Use of Service

LumenPostAI provides tools for AI-assisted Instagram content creation and scheduling. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

You must not misuse the Service by knowingly introducing viruses, trojans, worms, or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our Service, the server on which our Service is stored, or any server, computer, or database connected to our Service.

You must have an Instagram Business or Creator account linked to a Facebook Page to use content publishing features. LumenPostAI is not responsible if you cannot use certain features due to your Instagram account type or setup.

3. AI Generated Content

The Application utilizes artificial intelligence (AI) to generate content such as captions, hashtags, and image concepts. While we strive for accuracy and appropriateness, AI-generated content may sometimes be inaccurate, incomplete, or offensive. You are solely responsible for reviewing, editing, and verifying any AI-generated content before publishing it. We are not liable for any consequences arising from the use of AI-generated content.

You retain ownership of the original prompts you provide. The ownership of AI-generated content may be subject to the terms of the underlying AI service providers (e.g., Google Gemini) and applicable law. You are responsible for ensuring you have the necessary rights to use and publish any content generated or managed through the Service.

4. User Content & Instagram Connection

You retain all your rights to any content you submit, post or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in connection with providing the Service.

You are responsible for your content, including its legality, reliability, and appropriateness. You warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the content you submit.

By connecting your Instagram account to LumenPostAI, you grant us permission to access your account as per the permissions requested during the OAuth flow, which may include publishing content, reading profile information, and other actions necessary to provide the Service. You can revoke these permissions at any time through your Instagram/Facebook settings.

5. Subscription, Fees, and Payment

Certain features of LumenPostAI may be subject to payment (Subscriptions). All fees are quoted in Euros (€) unless otherwise specified and are exclusive of applicable taxes. We use third-party payment processors (e.g., PayPal, Google Pay) to bill you. The processing of payments will be subject to the terms, conditions, and privacy policies of these payment processors.

Our subscription plans and their specific features and limitations are detailed on our pricing page. We reserve the right to change our subscription plans or adjust pricing for our Services in any manner and at any time as we may determine in our sole and absolute discretion.

The "Pro" plan has a minimum subscription period of three (3) months after any trial period. Early cancellation options may be limited as per this term.

Free trials are offered at our discretion and are subject to the terms specified at the time of the trial offer. If you do not cancel your trial before its end date, it may automatically convert to a paid subscription as described.

6. Intellectual Property

The Service and its original content (excluding content submitted by users and AI-generated content based on user prompts, subject to AI provider terms), features, and functionality are and will remain the exclusive property of Code7aven and its licensors. LumenPostAI is protected by copyright, trademark, and other laws of both Germany and foreign countries.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms and Conditions.

8. Limitation of Liability

In no event shall LumenPostAI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
